1. Acceptance of Terms

By accessing or using the website at theprettiestpieces.com (the "Site") operated by The Prettiest Pieces ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Site.

2. Eligibility

You must be at least 18 years of age to use our Site or make a purchase. Our services are available only to customers located within the United States and its territories. By using the Site, you represent that you meet these eligibility requirements.

3. Account Registration

To place an order, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to provide accurate and complete information and to update your information as necessary.

4. Products & Pricing

All products listed on our Site are vintage, antique, or curated furniture and home decor items. Each item is unique and sold as-is unless otherwise noted. Prices are listed in U.S. dollars and are subject to change without notice.

We make every effort to display product images and descriptions accurately. However, because our items are vintage and unique, slight variations in color, texture, and condition may exist. Product images are for illustrative purposes and may not capture every detail.

5. Orders & Offers

All orders are subject to review and approval by our team. Placing an order does not guarantee acceptance. We reserve the right to decline any order for any reason.

Full-Price Orders: When you submit a full-price order, your payment method will not be charged until the order is reviewed and approved by our team.

Offer Orders: You may submit an offer at a discount (10%, 25%, or 50% off the listed price). For offer orders, a 50% upfront payment of the offered total is required at the time of submission. This upfront payment is charged immediately. If your offer is approved, the remaining balance will be charged. If your offer is declined, the upfront payment will be refunded.

6. Payment Terms

We accept payment via credit and debit cards processed through Stripe. All payment information is handled directly by Stripe and is subject to Stripe's Terms of Service. We do not store your full card number on our servers.

7. Shipping & Delivery

Shipping costs and timelines will be determined during the order review process. Our team will work with you to finalize shipping arrangements before your order is approved and payment is collected. Delivery times may vary based on item size, destination, and shipping method.

Risk of loss and title for items pass to you upon delivery to the carrier. We are not responsible for delays caused by the shipping carrier.

8. Returns & Refunds

Due to the unique nature of our items, all sales are final unless the item arrives damaged or is significantly not as described. If you believe an item was damaged during shipping or is materially different from its description, please contact us within 48 hours of delivery at info@theprettiestpieces.com with photos of the item and packaging.

Refunds for declined offer orders (the upfront payment) will be processed within 5-10 business days back to the original payment method.

9. Intellectual Property

All content on the Site, including but not limited to text, images, logos, graphics, and design, is the property of The Prettiest Pieces or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written consent.

10. User Conduct

You agree not to:

• Use the Site for any unlawful purpose
• Submit false or misleading information
• Interfere with or disrupt the Site or its servers
• Attempt to gain unauthorized access to any part of the Site
• Use automated tools to scrape, crawl, or extract data from the Site
• Submit fraudulent orders or offers

11. Limitation of Liability

To the maximum extent permitted by law, The Prettiest Pieces shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising from or related to your use of the Site or any products purchased through the Site.

Our total liability for any claim arising from or related to these Terms or the Site shall not exceed the amount you paid to us for the specific product giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless The Prettiest Pieces, its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to your violation of these Terms or your use of the Site.

13. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Guilford County, North Carolina.

14. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site after any changes constitutes acceptance of the modified Terms.

15. Termination

We may terminate or suspend your account and access to the Site at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
